General Terms and Conditions (GTC) for “Nachbar Berlin”
1. Scope of Application

These General Terms and Conditions (GTC) apply to the use of the website, the social media channels, and the presence and services in the “Nachbar Berlin” bar.

2. Video Surveillance
​
- Our bar is equipped with a video surveillance system for the safety of guests and employees. Surveillance is carried out in accordance with data protection regulations. Signs provide information before entering. This data is deleted fully automatically after 14 days. Recordings are stored on a case-by-case basis if and for as long as this is necessary for the safety of visitors and to investigate criminal offenses. A general evaluation of data does not take place.

3. During regular NachBar Berlin operation, admission is only from the age of 18! (Please bring ID with you)
Exceptions to this are special events where admission for young people under the age of 18 may be permitted if accompanied by a parent or guardian. The organizer of these special events assumes sole liability and guarantee for the actual implementation of the respective event to the full extent.

4. Entering the event venue is at your own risk.
Claims for damages against the organizer due to negligence are excluded. This also applies to its legal representatives or vicarious agents. This regulation does not apply to damages due to injury to body, life, health, as well as gross negligence or intent on the part of the organizer or due to the violation of essential contractual obligations, whereby the claim for damages is limited to compensation for the foreseeable, typical damage. Any further liability is excluded.
5. Nachbar reserves the right to refuse admission to the visitor for good cause (Clause 5.2) if this is justified in the person of the visitor.
5.2 Good cause includes, but is not limited to, the carrying of prohibited items in accordance with Clause 7 of the applicable GTCs, an obvious heavily intoxicated state of the visitor, an existing house ban, if the visitor is obviously under the influence of drugs or has an obviously sexist, homophobic, racist or inhuman attitude. Admission will also be refused if the protection of minors is violated. If there is an aforementioned important reason for refusing admission, the tickets or festival wristband will lose their validity and the admission price will not be refunded.

5.3 For reasons of security and order and to avoid waste, staff are instructed to carry out a body and bag search of visitors. The person requesting admission agrees to this check. If they do not do so, they may be refused admission.​
5.4 Instructions and directions given by security staff and personnel, especially in the event of danger, must be followed.​
6. No liability is accepted for checkrooms, rucksacks, bags and in particular their contents.​
6.2 Liability is assumed for checkroom items stored in the checkrooms if the loss of a checkroom item is established on the basis of a valid checkroom receipt. Checkrooms will only be returned on presentation of a valid checkroom receipt. However, no liability is assumed for the contents of the checkroom. If the checkroom ticket is lost, no liability is accepted for the checkroom. It will only be returned after the personal details have been recorded at the end of the event or on the next working day.​
6.3 It is prohibited to bring glass containers, cans, drinks, tape recorders, film and video cameras, pyrotechnic objects, flares, sparklers, weapons and similar objects, as well as substances subject to the Narcotics Act. Failure to comply with this prohibition may result in expulsion from the NachBAR.
7. Photography for private use with 35 mm cameras and cell phones is permitted. The personal rights of third parties must be respected at all times.
8. The guest agrees and grants the organizer the right to make image, sound and video recordings of him/her during the events without any remuneration and to use them or have them used in the media mentioned under point 7.2, in particular for reporting, for advertising the events & the NachBAR venue, for sponsorship acquisition and all other business activities of the organizer. The organizer assures the visitor that recordings of the service providers commissioned by him will only be handed over to the neighbor BHS Entertainment GmbH for use without data identification in accordance with the DSGVO.​
9. Serving Alcohol and Minors​
- Age: The serving of alcoholic beverages to persons under the age of 18 is prohibited in accordance with § 9 JuschG. Age verification may be required.​
10. Volume and Smoking Behavior in the Bar
​
- Volume: Our bar attaches great importance to a pleasant sound ambience. The volume corresponds to that of comparable bars in Berlin and is within the legally permitted limits. The volume may be increased during events, but only within the legal sound limits.
- Smoking: Smoking is permitted in “Nachbar Berlin” in order to offer an authentic bar experience. Smoking areas are set up in accordance with legal requirements to ensure the well-being of all guests:
- Smoking areas are clearly marked and physically separated from non-smoking areas to ensure the health protection of non-smokers.
- All legal requirements for the protection of non-smokers are complied with and it is ensured that the ventilation systems extract smoke to maintain air quality.
- Guests who do not wish to be exposed to smoke can remain in the non-smoking areas.
11. Use of the Website and Social Media

- By using our website and social media channels, you agree to these terms and conditions.
- We reserve the right to remove or edit content that violates these terms.
12. Uploading and Use of Photos
12.1 Consent to use

- By uploading photos to our website or our social media channels (e.g. Instagram, Facebook, TikTok, Google...), you agree that “Nachbar Berlin” may use these photos for marketing purposes. This includes, among other things, use in:
- Online advertising
- printed materials
- Social media posts
- Public events and functions

12.2 Personal rights
- You warrant that you have obtained all necessary consents from all persons depicted in the images.
- The persons depicted must have been informed that the images may be published and must have given their consent.

12.3 Rights to the uploaded photos
- By uploading, you grant “Nachbar Berlin” a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, distribute and publicly display the photos.
12.4 Revocation of Consent
- You can revoke your consent to the use of your photos at any time in writing or by e-mail to info@nachbar-berlin.com.
- After receiving your revocation, we will remove the photos from all relevant platforms within 30 days.
13. Disclaimer

- “Nachbar Berlin” accepts no liability for content uploaded by customers.
- Customers are responsible for ensuring that the uploaded photos do not violate any copyrights, personal rights or other rights of third parties.

16 Liability in the Bar

- The bar accepts no liability for lost or damaged items.
- Damage caused by guests can be replaced.

17. changes to the GTC

- We reserve the right to amend these GTC at any time. You will be informed of any changes via our website or social media channels.
- The use of our services after such a change means acceptance of the new conditions.

18. Final Provisions
​
- Should parts of these GTC be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- The place of jurisdiction for all disputes arising from or in connection with these GTC is Berlin, provided that the customer is a merchant or has no general jurisdiction in Germany.
